These Terms of Service (the "Terms") govern your access to and use of vapeonmain.ca (the "Site"), our online ordering services, our local delivery service, and our retail store at 5819 132 Ave NW, Edmonton, AB T5A 1C3 (collectively, the "Services"), operated by Vape On Main ("we," "us," or "our"). By accessing the Site, placing an order, or accepting delivery, you agree to be bound by these Terms in full.
1. Age Restriction — 18+ Only
You must be at least 18 years of age to access this Site, purchase products from us, or accept delivery of any order. By using the Site you represent and warrant that you are 18 or older. We comply strictly with the federal Tobacco and Vaping Products Act and Alberta's Tobacco and Smoking Reduction Act.
2. Legal Name & ID Match — Critical
To prevent age-restricted product sales to minors and to comply with Alberta law:
- The name you enter at checkout must be your full legal name as it appears on your government-issued photo ID. Nicknames, initials, abbreviations, or aliases are not acceptable.
- By placing an order you confirm that the name on the order is your legal name and that you will be the person receiving delivery or pickup.
- Orders placed under false names, third-party names, or fraudulent identities will be cancelled and may be reported to law enforcement.
3. Delivery ID Verification — Mandatory
Every local delivery requires in-person ID verification at the door:
- The recipient must be physically present at the delivery address.
- The recipient must produce valid government-issued photo ID (Alberta driver's licence, Alberta ID card, Canadian passport, permanent resident card, or other acceptable photo ID).
- The name on the photo ID must match the name on the order exactly.
- The recipient must be 18 years of age or older as verified by date of birth on the ID.
- The recipient must appear sober and capable of receiving an age-restricted product.
If any of these requirements is not met, the driver will refuse delivery and return the order to our store. Refused orders are subject to Section 6 of our Refund Policy — shipping and product costs are non-refundable.
4. Health Canada Warning
Vaping products contain nicotine, which is highly addictive. They can harm your health. Vaping is not recommended for youth, pregnant individuals, people who do not currently smoke, or anyone with respiratory or cardiovascular conditions. 5. Order Acceptance & Right to Refuse
Submitting an order is an offer to purchase. Your offer is only accepted when we issue an order confirmation. We reserve the right to refuse, cancel, or modify any order for any reason — including suspected fraud, age verification failure, legal-name mismatch, stock unavailability, pricing errors, or violation of these Terms. If we cancel a paid order we will refund the original payment method in full.
6. Pricing & Payment
All prices are in Canadian Dollars (CAD) and exclude applicable taxes (GST, Alberta provincial vaping tax, federal excise duty). Final taxes are calculated at checkout. Prices may change without notice. We may correct pricing errors and cancel affected orders even after payment. Payment is processed through Shopify Payments / Stripe; full credit card numbers are never stored on our servers.
7. Shipping, Pickup & Local Delivery
- In-store pickup at 5819 132 Ave NW is free. Valid matching photo ID required.
- Local delivery is offered within our Edmonton-area delivery zone. Rates start at $10 and scale with distance from our store (final rate confirmed at checkout).
- Delivery age and ID verification per Section 3 above is mandatory and non-negotiable.
- We are not responsible for delays caused by the courier, weather, or events outside our reasonable control.
- Risk of loss passes to you upon successful pickup or successful delivery.
- For orders outside our local delivery zone, courier shipping (Canada Post) may be available; the same ID verification requirements apply at the destination.
8. Returns & Refunds
All sales are final. See our Refund Policy for the limited exceptions for defective hardware and shipping errors.
9. Accounts
If you create an account you are responsible for maintaining confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms.
10. Promotions, Discounts & Coupons
Discount codes are subject to the specific terms posted with each offer. Codes may be limited per customer, may not stack with other discounts, may exclude certain products, and may be withdrawn at any time. Promotions have no cash value and cannot be applied retroactively.
11. User Conduct
You agree not to use the Site or Services to:
- Violate any Canadian, provincial, or municipal law.
- Misrepresent your age, identity, or legal name.
- Resell our products without written authorization.
- Scrape, reverse-engineer, or interfere with the Site or its underlying systems.
- Upload viruses, malicious code, or harmful content.
12. Intellectual Property
All Site content — including logos, copy, graphics, photography, and design — is the property of Vape On Main or its licensors and is protected by Canadian and international copyright and trademark law. You may not reproduce, distribute, or create derivative works without prior written consent. Manufacturer brands and logos remain the property of their respective owners.
13. Disclaimers
The Site and all products are provided "as is" and "as available." To the maximum extent permitted by law we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. Vaping products are not therapeutic, medical, or smoking-cessation products. We make no health claims of any kind.
14. Limitation of Liability
To the maximum extent permitted by law, Vape On Main, its owners, employees, suppliers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with the Services. Our total aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless Vape On Main from any claim, loss, or expense (including legal fees) arising from your breach of these Terms, your misuse of any product, your providing false identity or age information, or your violation of any law.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Alberta, Canada and applicable federal laws. Any dispute shall be brought exclusively in the courts of Alberta, located in Edmonton, and you consent to the jurisdiction of those courts.
17. Changes to These Terms
We may revise these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Services after a change constitutes acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
